1. Introduction & Site Management

Welcome to ShamrockJacks.com. These Terms and Conditions ("Terms") govern your use of our website and the purchase of products and tickets. This website is owned by Shamrock Jack’s ("we," "us," or "our") and is managed and operated by Digital Space Innovations ("DSI").

By accessing this site, you agree to be bound by these Terms. If you do not agree, you may not use our services.

2. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the State of New York. Any disputes shall be resolved exclusively in the state or federal courts located in Monroe County, New York.

3. Swag Store (Merchandise) Policy

  • Local Pickup Only: All items are for local pickup only at our physical location.

  • 30-Day Hard Deadline: You must collect items within 30 days of receiving the "Ready for Pickup" notification.

  • Forfeiture: Items not claimed within 30 days are considered abandoned and will be donated.

  • No Refunds: No refunds or credits will be issued for abandoned/donated items.

  • Product Accuracy: We strive for accuracy, but we do not warrant that product descriptions or colors are accurate, complete, or error-free.

  • Pricing Errors: We reserve the right to cancel orders placed for products listed at an incorrect price due to typographical errors.

4. Event Ticketing & Venue Policies

  • All Sales Final: No refunds, no exchanges, no exceptions.

  • Non-Transferable: Tickets may not be resold or transferred.

  • Force Majeure: We are not liable for cancellations due to Acts of God (weather, disaster, war, pandemic). No refunds will be issued in these cases.

  • Right to Change Lineup: We reserve the right to change the entertainment lineup, start times, or supporting acts without notice. Such changes do not entitle you to a refund.

  • Right to Refuse Service & Ejection: We reserve the right to deny entry or eject any patron for intoxication, disorderly conduct, or aggression without refund.

  • Alcohol Policy: We strictly enforce New York State alcohol laws. Valid ID is required. Failure to provide ID results in denial of service.

  • Dietary & Allergen Warning: Our food and beverages may contain allergens (including but not limited to peanuts, gluten, dairy, and shellfish). It is the patron's responsibility to verify ingredients before consumption. We are not liable for allergic reactions.

  • Parental Responsibility: Supervision of minors is the sole responsibility of the accompanying parent or guardian. We are not liable for the actions, safety, or whereabouts of unattended minors.

  • Search Policy: You consent to a search of your person and belongings upon entry. Prohibited items (weapons, outside alcohol) will be confiscated.

5. Parking & Premises Liability

  • Parking Lot Liability: Shamrock Jack’s and DSI are not responsible for damage to vehicles, theft of vehicles, or theft of articles from vehicles parked on our premises or in adjacent lots. Please lock your vehicle and hide valuables.

  • Assumption of Risk: You voluntarily assume all risks and dangers incidental to attending our events, whether occurring before, during, or after the event, including but not limited to loud noise, strobe lights, crowds, and personal injury.

6. Media Release

By attending a Shamrock Jack’s event, you grant us and Digital Space Innovations the irrevocable right to use your image, likeness, voice, and video recordings in any media (including social media and marketing materials) without compensation or approval.

7. Intellectual Property & User Content

  • Ownership: All content on this site is the property of Shamrock Jack’s or Digital Space Innovations.

  • Unsolicited Idea Submission: Any ideas, suggestions, concepts, or feedback you submit to us (e.g., new menu items, event themes, marketing ideas) become our sole property. We may use them for any purpose without compensation or acknowledgement to you.

  • User Reviews: By submitting reviews or comments, you grant us a royalty-free, perpetual license to use, reproduce, and publish your comments for marketing purposes. We reserve the right to remove any content we deem inappropriate.

8. Payment & Financial Terms

  • Non-Refundable Fees: Ticket processing fees, service charges, and "convenience fees" are non-refundable under any circumstances, including event cancellation.

  • Chargebacks: You agree not to initiate a chargeback with your bank if you have received the goods or violated these Terms (e.g., failed to pick up swag). We reserve the right to ban users who initiate fraudulent chargebacks and pursue legal action to recover funds.

  • Right to Limit Quantities: We reserve the right to limit sales to any person or jurisdiction to prevent scalping or resale.

9. Limitation of Liability & Indemnification

  • Indemnification: You agree to indemnify, defend, and hold harmless Shamrock Jack’s and Digital Space Innovations from any claim or demand, including reasonable attorneys’ fees, made by any third party due to your breach of these Terms.

  • Limitation: In no case shall Shamrock Jack’s or DSI be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages.

10. Dispute Resolution

  • Binding Arbitration: Any dispute arising from these Terms shall be settled by binding arbitration in Monroe County, NY, rather than in court.

  • Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class-action lawsuit.

  • One-Year Time Limit: Any claim or cause of action arising out of your use of the site must be filed within one (1) year after such claim arose or be forever barred.

11. Website Operations & "As Is" Disclaimer

  • "As Is" Service: The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties, or conditions of any kind.

  • Accessibility: We strive to adhere to WCAG 2.1 guidelines. If you have difficulty accessing our site, please contact us.

  • Termination: We may terminate your access to the site at any time, without notice, for conduct violating these Terms.

  • Third-Party Links: We are not responsible for the content or practices of third-party websites linked on our site.

12. Additional Legal Provisions

  • Entire Agreement: These Terms and any policies or operating rules posted by us constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements.

  • Email as Binding Notice: You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically (via email or website posting) satisfy any legal requirement that such communications be in writing.

  • SMS/Text Marketing Consent: By checking the box at checkout, you consent to receive recurring automated marketing messages and "Swag Pickup" alerts at the phone number provided. Consent is not a condition of purchase. Msg & data rates may apply.

  • No Waiver: The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

  • Severability: In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall not affect the validity of the remaining provisions.

  • Gift Card Terms: Gift cards are not redeemable for cash (except as required by law), and we are not responsible for lost, stolen, or damaged cards or any unauthorized use.

  • Assignment: We may assign or transfer our rights and obligations under these Terms to any party at any time without notice. You may not assign or transfer your rights or obligations.

  • DMCA Notice: If you believe your copyright has been infringed by content on our site, please contact our designated agent at ShamrockJacks@Yahoo.com with a takedown request compliant with the Digital Millennium Copyright Act.

  • Health & Safety: You agree to comply with all health and safety protocols (including capacity limits or mask mandates) enforced by the venue or New York State at the time of the event.

  • Headings: The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
